1. Scope
These General Terms and Conditions (GTC) apply to all accommodation contracts and related services concluded by TKB Hotels GmbH, Garnisongasse 4/11, 1090 Wien, as operator of Hotel Herzoghof, Kaiser-Franz-Ring 10, 2500 Baden bei Wien, Austria (“Hotel”), with its guests (“Guest”) – regardless of whether the booking is made on our website, by phone, by e-mail or via a booking portal.
Deviating terms of the Guest apply only if the Hotel has expressly agreed to them in writing.
2. Conclusion of contract
When booking on our website, the Guest makes an offer by clicking “Book now”. The accommodation contract is concluded with the Hotel's booking confirmation, which is shown on screen immediately after the booking and sent by e-mail to the address provided. The booking number must be quoted in all matters concerning the booking.
For bookings by phone or e-mail the contract is concluded with the Hotel's written confirmation. For bookings via travel portals the conditions shown there apply in addition; these GTC apply insofar as the portal conditions do not provide otherwise.
The Guest is responsible for the accuracy of the details provided, in particular the e-mail address and phone number. Subletting or re-letting the room and using it for purposes other than accommodation require the Hotel's prior written consent.
3. Prices, tourist tax and extras
All prices are in euros and include statutory VAT. The price shown in the online booking at the time of booking or stated in the confirmation applies. The direct rates on our website apply exclusively to bookings made on this website.
In addition to the room rate, the City of Baden tourist tax (currently €3 per person and night) is payable at the hotel; it is not included in the room rates shown and is stated separately during booking.
Breakfast is not included in the room rate and can be added during online booking for €10 per person and night; on site the price is €21.90 per person and day. A parking space can be booked for €16 per night; the Hotel has its own spaces and spaces in a partner garage nearby and allocates the space on arrival. Prices for extras are those valid at the time of booking.
4. Rates, payment and card guarantee
Two rates are offered in the online booking:
- Saver rate: The total amount (room and booked extras) is paid at the time of booking by credit card via our payment provider Stripe. The booking is non-refundable and cannot be changed.
- Flexible: The Guest provides a credit card as a guarantee at the time of booking; nothing is charged. Payment is made at the hotel. Free cancellation up to 2 days before the arrival day (see section 5).
If arrival is less than 2 days away, only the Saver rate is offered. At the hotel we accept cash and common debit and credit cards. The invoice is issued at check-out and is payable immediately unless otherwise agreed. For company bookings the invoice is issued to the company stated.
Card data are processed exclusively by Stripe; the Hotel does not store complete card data (see privacy policy).
5. Cancellation, no-show and early departure
- Saver rate: Cancellation is not possible; in the event of cancellation or no-show the total amount remains due and is not refunded.
- Flexible: Cancellation is free of charge up to 2 days before the arrival day (until 23:59 local time on the second day before arrival). For later cancellation or no-show the total amount of the booking becomes due and is charged to the card provided.
- Other booking channels: The conditions stated in the confirmation apply; if none are stated, the conditions of the “Flexible” rate apply.
Cancellations must be sent in writing to office@hotel-herzoghof.at; the time of receipt is decisive. In the event of early departure, the agreed price for the entire booked period is charged insofar as the Hotel cannot let the room otherwise. Expenses saved by the Hotel are credited.
6. No right of withdrawal (FAGG)
Pursuant to § 18 (1) no. 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG), there is no statutory right of withdrawal for consumers for accommodation contracts that provide for a specific period of performance. Only the cancellation conditions of the booked rate apply.
7. Arrival and departure
Rooms are available from 3 pm on the day of arrival and must be vacated by 11 am on the day of departure. Earlier arrival or later departure is possible subject to availability and prior arrangement; a surcharge may be charged for departure after 11 am. For arrival after 10 pm we ask for prior notice.
On arrival the Guest must provide the details required under the Austrian Registration Act and present an official photo ID.
8. Rooms and changes to services
A room category is booked, not a specific room. If the Hotel cannot provide the booked category for reasons beyond its control, it will provide a room of equal or higher category at no extra charge. If only a lower category is available, the price difference is refunded or the Guest is offered free withdrawal.
Descriptions of facilities and surroundings on the website are for information and do not constitute a warranty of particular characteristics unless expressly confirmed in the booking confirmation.
9. Guest obligations, smoking, pets
The Guest must treat the room and the Hotel's facilities with care; damage caused by the Guest or accompanying persons is charged at the cost of repair or replacement. Smoking is prohibited in all indoor areas; a cleaning fee of €150 is charged for violations. Consideration must be given to other guests' night rest from 10 pm; in the event of serious disturbance the Hotel may terminate the contract without refund.
Pets are permitted only by prior arrangement with the Hotel and for a surcharge. The Guest is liable for all damage caused by the animal.
10. Liability
The Hotel is liable for damage in accordance with statutory provisions. For items brought in, the Hotel is liable as an innkeeper under §§ 970 et seq. of the Austrian Civil Code (ABGB) up to the statutory maximum; for valuables, cash and securities only if they were handed over to the Hotel for safekeeping. The Hotel does not take custody of vehicles in the parking spaces or the partner garage or of items inside them; liability is governed by law.
The Hotel is not liable for disruptions caused by force majeure, official orders, strikes or other circumstances beyond its control.
11. Events and seminars
For seminars, celebrations and other events a separate event contract is concluded governing room hire, catering, minimum spend, technology and cancellation terms. These GTC apply in addition insofar as the event contract does not provide otherwise.
12. Data protection
The Hotel processes the Guest's personal data in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG). Details are set out in our privacy policy.
13. Applicable law, jurisdiction, dispute resolution
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers the statutory places of jurisdiction apply; for businesses the competent court in Vienna is agreed. The contract language is German; in the event of discrepancies between the German and English versions of these GTC, the German version prevails.

14. Final provisions
Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected. The version of these GTC published at the time of booking applies to the respective contract.
